I have an H1B approval from USCIS, and I am trying to go to Canada for the initial visa stamping. But then i have a problem. I initially entered the country as a visitor, and married a citizen, but only after my I-94 had expired for about a week. (My petition is still pending. The company I am working for could not wait for my greencard, since its already been years since I started that process, so they went ahead and applied for the H1B visa for me). I heard that it is a problem to do the visa stamping in Canada if you have been out of status before. Is it advisable to go to Canada for the visa stamping?

Hi,
Once our 140 is approved in the sixth year of H1B, I learnt that we can seek a 3 yr extension. If that's the case, can we change companies during that 3 yr period or are we stuck with the same company that sponsored the 3 yr extension?

I am trying set up an appointment for the last week of April (Apr 27-May 1) in Matamoros, Mexico and came across the following website about their wait times:

It depends, on several factors inlcuding which service center it filed, is there any RFE or any document missing etc.
In ideal case it geenrally takes 4-8+ weeks.
If you want any fater within 2 weeks) you can file under premium prossing with addtional 1000$ fee.

My daughter is on F1 visa since she turned 22 years. She has her AOS (employment based dependent on me) pending. I-140 cleared and I -485 filed before she turned 22 years. She has also received her EAD and AP based on pending AOS.
We are planning to go to Canada and she want to use AP for reentering USA. My question is:
1) Once she enter USA using AP what happens to her F-1 status? Can she continue her F-1 status?

Hello everyone,
I have heard that if you cancel your first LC and apply for a Second one you can still use the advertisements and all from the first one if you fall withing that "6 month" period. My question is -
Is it 6 month from the first day that the advertisement was published or is it 6 month from the day your first LC was approved? :confused:
Experts please shed some light on this.

I am applying to renew my EAD and looking at the paper Application on page 7 I see that if you are C9 which all of us are mostly..we need not file an application fee..

I am on H1 Right now and through the same employer i filed my GC in May 2007 (I-140 approved in Oct' 2007)
but I have got an offer from another company who is willing to transfer my H1, so wanted to know what is the best options.
- Should i Switch on H1 and if yes, can i start working for them before the H1 Transfer process is complete
- If I did decide to go on H1 then do i need to file some documents for my I-485 and EAD Renewal as well (meaning do i have to inform USCIS about my change in employer for GC application)

Hello All,

Company -A - EB3 - PD of March 2003
Company -B - EB2 - PD of March 2006 (PERM)
I got my Labor, I -140 from company B, and applied for 485 recently (July-2nd).
Recently (Last week) I got the labor approved from Company A (as it went to Backlog).
I was thinking that If I get I-140 from Company A then, My layer wants to use that Priority date in already filed 485 case.
But to get the I-140 from the Company B, I may have to spend around 3k, so just thinking if it is worth doing or not.
Any suggestions?

I am planning to get religiously married by end of next year, 2009. But I am considering doing a quick court marriage in the next week since my dates are current. I have a couple questions regarding time frame:
1. If I do get my GC soon, then I need to apply for following-to-join. Is there a time limit for this? Can I do it as late as I want, as long as the spouse doesnt come to US before?
2. If I do not get GC for a while, is there a time frame after marriage before which I have to apply for my spouse's 485 as a dependent? Does she also need to be on H4 and in US before applying for 485?

After at least 3 - 4 calls, over the last month, I finally spoke to IO at NSC. And she took my LIN numbers(other IOs did not even bothered). And then after 1 minute she replied that..my case is waiting to be assigned to Officer.
I even got my I140 checked but she was patient and told my HR that whole cas e is waitng to be assigned to Officer.
Is this something to be looking forward to or is it a usual reply?
Did anyone get this kind of reply?

My wife and I, currently have EADs. My wife has been offered a job and they need a Green Card when she joins in May 2008.
Is there a way to expedite the processing of I-140 and I-485, so that we do get our Green Cards in next month or so?

Though my employer is located in Kansas, we got TSC receipts and now when I extended my EAD, I got NSC's receipts...(heard it is lreatde to laod sharing among SC's)
BTW Is this a big deal in approving 485???
Anyways, can someone pls direct me(if there is thread covering 2004 approvals) or share your thoughts around PD 2004 approvals?

Hello All,
My checks got deposited on Friday and when I checked my wife's I 485 status with the LIN # on the back of the check, it said that the finger printing fee was rejected and that the case is now in suspense.
It said that I have to submit a new fee and that the case will be resumed again.
Do you know why this happened. My bank statement says that the finger printing check for her got deposited.
So if there is a mistake in the check, would they still deposit it ? And would her EAD application get processed even if the finger printing fee is wrong ?
Did this happen for anyone ?
