Hi All,
I have I-140 with PD of 2004 from previous company. From the current company I had started new GC process.
a) Previous labor title is software engineer. New labor title is Computer support specialist.
b) New perm process just started and job order has been posted last month.
In the job order company didnt give much details and only one sentence which is related to the old labor job description though it has 8 lines describing the job description
c)Should the above be a problem for porting the PD? Also current company has not done the sunday ads. Can they include all 8 lines describing the job description in the sunday ads?
d)I am in Viriginia and which sunday news papers do you recommend(EB2)
category.
e) Is there any PERM filing fee ?

The primary can keep working on H1. If you don't plan on changing your job, be on H1. If there is any issue with your application, then you are still on H1. If you are on EAD and your application is denied, then your EAD also becomes invalid.

My I-140 (National waiver approved, no labor required, self-petition) is approved, both me and my wife are working on EAD. Have valid AP till Oct 2009. 485s filed July 2007.
Today, on 10th, my wife (dependent 485) got hard LUD, "request for evidence notice sent" is the update.

The RFE is for absence of child's name (my wife) on the birth certificate. They wanted another birth certificate, hospital document or religious record or civil authority record that shows her name and both the parents names. They gave us 90 days time.

Hi, i have filed I-140 3 months back and it is still in process. Am I able to file I-485 in parallel to the I-140 now.
Whats your country of chargeability and category...
EB1 - Yes, you can
EB2- ROW - Yes
EB2 I/C - wait time is 3-5 years
EB3 I/C - wait time is 10-12 years
EB3 - ROW - wait time is 5-6 years.

I am on H1-B visa and applying for my wife's passport(in india),one of the document for making passport is an NOC from husband that has to get from indian embassy which i didn't find on their website(any application for spouse),has anyone come across this situation.Please let me know.

My employer filed H1B transfer in Feb 2009. however he could not receive RFE letter with in time on mail and only received after RFE submitted date was expired which is May 25th, 2009
In jun1 1st week , he filed for the RFE extension for the stated reason and also refiled H1B to make sure that I should be in valid H1B status in case of first H1B denial in mean time
Employer submitted all the documents related to RFE on June 20th and it got approved on jul 1st.
What are the best options for H1B refiling case
in case if it is denied, will it super impose the original H1B approval ?
is it good idea to cancel/revoke pending H1B refiling case ?

Hi,I have filed H1B during August 09 ..my priority dates became current in Sep 09 and I have filed for AOS -485 /EAD ..Should I cancel my H1B or will it automatically get canceled once I receive my EAD ?Please suggest.

Hi Friends,
I work for a big 4 consulting firm and transferring my H1-B to a client (a 2 Billion dollar american company).......I'm planning to join my new company only after the visa has been transferred ........my questions are:
1.) If the transfer is rejected, can I work for my current employer (assuming I dont resign)
2.) My wife's on H4 and recently applied for COS from H4 to F1 - Do I need to file for her H4 transfer also or not?
Not sure what's the effect of H1 transfer on wife's pending H4 to F1 application.
Need help ASAP. Thanks a lot.

My friend has his I-485 filed and has got EAD/AP, but the priority date is so behind, that he has no chance of getting a green card before his marriage. So, as I understand he should be able to bring his wife on H4 (as long as he maintains H1). My question is: does he have to re-file for I-485 to include his wife and if so will the priority date remain the same as the first application?She needs to file her own I-485 but only when PD become current. She has the same PD as primary applicant.

i have it on Nikon mount, and one of the samples i tested had a back focus issue. i just bought the one that didnt. Sigma is real good at fixing/replacing defective lenses
