Hello,
I have a RFE for my 485 according to the online status. My PD is current, and NSC's 485 processing time is now July 19, 07. My 485 RD was July 25, 07, so it is likely that they are working on adjudicating my case (and could have approved if there were no RFE).
I am still waiting for the RFE in the mail to know what it is exactly. But, assume that I fulfill their request and mail them the required items immediately, will I need to wait another 6 months before they check my RFE fulfillment? Or do they usually look at the RFE immediately (since they are already working on my case)...

I'm looking to travel to Puerto Rico for a few days in July for my honeymoon but both my green card and passport have both expired. I have been in the US since 1988 and don't travel aboard very often so I overlooked this issue.
I have been told that I can travel to Puerto Rico with just a valid driver's license but don't want to take a chance of having them ask me for my passport and green card and then not being allowed back in the country. I would think that if they ask me if I'm a resident alien, they woudl want to see a non expired green card. I assume it is too late to go through the renewal process for both with just a few weeks left before my trip. I would love to know if I need to go through the renewal process for my passport, green card or both in order to fly to Puerto Rico or if I should just stick to US states.

On November 27, the USCIS announced that they had received 58,900 H-1B petitions toward the 65,000 cap. So there are 6,100 numbers remaining, correct? We can see more of these GC approvals and visa number allocation in September because USCIS and DOS have to use up all available visa numbers.
If not, we can see again about 10,000 visa numbers unused and wasted.

I definitely want to see other D2x vs. 1DsMkII tests before making any conclusions about the resolution, but even assuming the 1DsMkII holds the advantage, I'm certain that it won't be visible in real world prints that aren't at extreme sizes. That was a fairly good review, anyway. :)

What a chaos? We were so close, turned out to be mirage. When do you expect your GC? My PD is Feb 2006. I do not expect anything positive in 3 years. I doubt anything changed in our career in 2 years. Where do we stand?

Hi
I am working on H1B from Oct 2009. My employer and client has one layer between of them. For some family reason I need to visit India for 10 days. Will it cause any problem / Issue on airport (immigration counter) when I will come back to USA ?
In this case how can I prepare myself to face situation? What documents do I need to prepare to prove that even though I am working with one layer then also my employer control my salary and tax stuffs ?

PIC countries benefited from unused visas a lot till now to have their PD current/move up. So based on that benefit, Also one thing is clear the unused visas if available are country indepedent and are used at the rate of 27% per quarter.
so for example 100K visas are available (which i would enjoy having )27K per quarter is available from the start of the year . Now among this 27K how is the distribution, can it be distributed whichever applicant needs PD IRRESPECTIVE of EB1,EB2,EB3(skilled, professional) Vs EB3 other or does it split by the calculations of EB1, EB2, EB3 with 28% EACH and EB3 other NOT above 10K limit

I'm Cuban and I met my wife while on a trip to the island. I brought her over to the states on a K1 visa. Unfortunately things did not work out between us. Now she is going back to the island for a while and plans to come back. She still has not been here the 1 year and 9 months she's required to stay married to me in order to fulfill all of the K1 visa requirements.
My question is; if she leaves the states and we have divorced, will she be able to re-enter the states?
Let me know if more info is needed.
Any advice/suggestion/counseling will be most appreciated.

I need advice from Gurus who have experience or gone through this. I am on H1B with pending I485 and i got married recently. My spouse is on H4.
I have been looking for a job and my employers want to hire me on EAD. If i use EAD, then my wife will be out of status.
Other option is for my wife to get into F1 status.
1. How easy to change the status from H1 to F1?
2. Should i wait to use my EAD till my wife's F1 status gets approved?
3. If the change of status gets denied, will there any problem to her H4 status?
